For the purposes of data protection law, PCMG Consulting Services Ltd is the data controller responsible for your personal data.
2. What Information We Collect
We may collect the following information:
- Full name
- Email address
- Home address
- Basic estate details (to prepare your Will)
- Information about executors, beneficiaries, and funeral wishes
- IP address and device information
- Any optional information you provide on our forms
This data is collected solely to enable us to prepare your Will and deliver our service.
3. How We Use Your Information
We use your information to:
- Prepare and deliver your Will documents
- Provide customer service and support
- Improve our services and website performance
- Comply with legal obligations
We do not sell or rent your personal data, and we never share it with other companies for their own marketing. We may share limited, encrypted (hashed) identifiers — such as your email address or phone number — with our own advertising providers (for example Google), only to deliver and measure ScottishWill’s own advertising. See section 8, “Advertising and audience matching”.
4. Legal Basis for Processing (UK GDPR)
We process your data under the following lawful bases:
- Contractual necessity – to prepare and deliver your Will
- Legitimate interests – to improve our services, prevent misuse, and promote our service (including the advertising described in section 8)
- Consent – for optional marketing communications (only if you opt in)
5. Data Security
All data is transmitted securely over SSL (https). We use secure servers, access controls, and encrypted platforms to protect your information.
All data is stored securely within the United Kingdom or the European Economic Area (EEA). Other than the limited hashed advertising identifiers described in section 8 (which Google may process outside the UK/EEA under an approved safeguard, such as the UK–US Data Bridge or Standard Contractual Clauses), we do not transfer your personal data internationally.
6. How Long We Keep Your Data
We keep your personal data only for as long as necessary for the purposes set out in this policy, including to meet legal, regulatory and accounting requirements and to defend potential legal claims.
Because a Will can remain in force for the rest of your life and a claim relating to its preparation may only arise after death, we retain the information used to prepare your Will, and a copy of the Will document, for the lifetime of the customer or for a minimum of 20 years from the date of delivery, whichever is longer. This reflects the long negative prescription period under the Prescription and Limitation (Scotland) Act 1973.
Other records are kept for shorter periods:
- Payment and transaction records: 6 years, to meet HMRC and accounting requirements.
- Marketing and contact preferences: until you withdraw consent or ask us to stop.
You can ask us to delete your data at any time. Where we are legally entitled or required to retain certain information (for example to defend a claim or meet a legal obligation), we will tell you and keep only what is necessary. You may request deletion of your data at any time by contacting us at contact@scottishwill.co.uk.
7. Your Rights
Under UK GDPR, you have the right to:
- Access the data we hold about you
- Request correction or deletion
- Withdraw consent (for marketing) at any time
- Object to processing where applicable
- Lodge a complaint with the Information Commissioner’s Office (ICO) at ico.org.uk
8. Third-Party Services
We use trusted third-party services to deliver our website, payments, and advertising, including:
- Tally Forms – to securely collect your information
- Stripe – for secure payments (we do not store your card details)
- Google Analytics – to measure anonymised site usage
- Google Ads – for online advertising and audience matching (see below)
- Elementor / WordPress – for website functionality
Each third party has its own privacy policy and meets GDPR compliance standards.
Advertising and audience matching
We advertise ScottishWill online, including through Google. To make our advertising more relevant and to reach people whose circumstances are similar to our existing customers, we may upload a list of customer contact details (such as email address and phone number) to Google’s “Customer Match” service.
Before this information leaves our systems it is converted into an irreversible encrypted form (“hashing”), so Google cannot read your actual email address or phone number. Google uses it only to match against its own signed-in users so we can show, or avoid repeating, our adverts, and is required to delete it after matching. We never share this data for any other organisation’s marketing.
Our legal basis is our legitimate interest in promoting our service efficiently. You can opt out at any time by emailing contact@scottishwill.co.uk, and you can manage personalised advertising in your Google account settings.
